General Terms and Conditions (GTC)

NOTE: This English version is a customer service translation. The legally binding document is the German version (AGB) under German law.

§ 1 Scope, Provider, and Definitions

  1. These General Terms and Conditions (GTC) apply to all contracts for the sale and delivery of goods concluded between the online shop CHIFU (Yusuf Albayrak, Kammelweg 6, 86381 Krumbach, Germany – hereinafter "Seller") and consumers (hereinafter "Customer").
  2. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity (§ 13 BGB).
  3. Insofar as the offered products are one-of-a-kind pieces, unique items, or used goods, this is expressly stated in the respective product description.

§ 2 Conclusion of Contract and Ordering Process

  1. The presentation of products in the online shop does not constitute a legally binding offer, but merely a non-binding invitation for the customer to submit an offer (invitatio ad offerendum).
  2. The customer submits a binding purchase offer by completing the order process by clicking the "BUY NOW" button.
  3. The Seller can accept the customer's offer within seven (7) working days of receipt. Acceptance is made either by (a) sending an order confirmation via email or (b) delivering the goods to the customer. The mere confirmation of receipt of the order does not yet constitute acceptance.
  4. The contract text (order and GTC) will be stored and sent to the customer in text form no later than upon delivery of the goods.

§ 3 Prices, Payment Terms, and Due Date

  1. All stated prices are total prices in Euro and include statutory value-added tax (VAT).
  2. In addition to the purchase price, shipping costs apply, the amount of which the customer can clearly see on the product page and during the order process. Costs for the shipping of bulky goods are shown separately.
  3. The purchase price is due immediately upon conclusion of the contract. Payment processing is handled by the payment service provider Stripe Payments Europe, Ltd., which offers various payment methods (e.g., credit card, PayPal, Klarna).
  4. The customer's account or credit card will be charged immediately after completing the order process, depending on the selected payment method.

§ 4 Condition, Delivery, and Transfer of Risk

  1. The products shown on the website are generally high-quality one-of-a-kind/unique pieces. The customer acknowledges that minor deviations in color, grain, texture, or dimensions, especially when using natural materials or handcrafted production, do not constitute a defect. The representation in the shop serves as a sample.
  2. Delivery only takes place within Germany, Austria, and Switzerland. The estimated delivery time is stated on the product page.
  3. Since the pieces are high-quality and possibly fragile, the Seller selects a specialized transport service provider. The risk of accidental loss and accidental deterioration of the goods transfers to the customer only upon handover of the goods to the customer or a recipient designated by them (§ 446 BGB).

§ 5 Right of Withdrawal and Cost of Return Shipment

  1. Consumers generally have a statutory right of withdrawal in accordance with the attached Right of Withdrawal instructions, which the Seller transmits to the customer in text form no later than upon delivery.
  2. Important Note on Return Costs (Shifting the Cost Risk): In the event of exercising the right of withdrawal, the customer bears the direct costs of returning the goods. Due to the size, weight, and value of the furniture pieces, these costs can be substantial. The customer is informed of the approximate amount of these costs on a separate information page before completing the order.
  3. Exclusion of the Right of Withdrawal (Custom Production): The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (§ 312g Para. 2 No. 1 BGB).

§ 6 Liability for Defects (Warranty)

  1. The statutory liability for defects (warranty) applies.
  2. Special Regulation for Used Goods/Showroom Items: If the purchased product is used goods or a showroom item expressly marked as such, the warranty period for consumers is reduced from the statutory two years to one (1) year from the delivery of the goods. This reduction does not apply to claims for damages resulting from injury to life, body, or health or from intentional or grossly negligent breaches of duty by the Seller.
  3. The customer is obliged to check the goods immediately upon receipt for obvious transport damage and, if necessary, to immediately report and document this damage to the delivery person. Failure to report the damage does not affect the statutory warranty claims.

§ 7 Liability

  1. Claims by the customer for damages are excluded. This exclusion does not apply to the customer's claims for damages resulting from injury to life, body, or health, or from the breach of essential contractual obligations (cardinal obligations), or to liability for other damages based on an intentional or grossly negligent breach of duty by the Seller, its legal representatives, or vicarious agents.
  2. In the event of a breach of essential contractual obligations, liability is limited to the contract-typical, foreseeable damage, unless there is intent or gross negligence.
  3. The provisions of the German Product Liability Act (Produkthaftungsgesetz) remain unaffected.

§ 8 Final Provisions and Place of Jurisdiction

  1. The law of the Federal Republic of Germany applies to contracts between the Seller and the customer, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The ineffective provision shall be replaced by the relevant statutory regulation.
  3. The European Commission provides a platform for online dispute resolution (OS), which you can find here: https://ec.europa.eu/consumers/odr. We are not obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
